Terms of Service

1. Acceptance

By creating an account or using gigly.com.au ("Gigly", "the Service"), operated by Gigly Pty Ltd (ABN 85 700 820 604), you agree to these Terms. If you don't agree, don't use the Service.

2. What Gigly is

Gigly is a marketplace connecting individuals across Australia seeking casual, part-time, weekend, and internship work ("Students") with businesses offering that work ("Employers"). Gigly facilitates introductions, applications, interview scheduling, and the associated fees below. Gigly does not employ Students, is not a party to any employment or engagement arrangement between a Student and an Employer, does not direct or control the work performed, and is not a labour-hire or recruitment agency — Employers engage Students directly and are responsible for complying with all applicable employment, work health and safety, and labour-hire licensing laws in respect of that engagement.

4. Identity verification

Students may submit a government photo ID (passport or driver's licence) and a second identity document — a student ID card, or another government or institution-issued photo ID — for verification. A "Verified" badge is shown on a Student's profile once Gigly has reviewed and approved the required documents. Gigly may reject documents that appear fraudulent, expired, or illegible, and may suspend accounts submitting false documentation.

5. Fees and payments

Posting a job, applying, and shortlisting are all free. Employers are charged as follows, via Stripe Checkout at the time each action is taken (Gigly does not store card details):

All amounts are in Australian dollars. Where GST applies to a fee, it is included in the price shown.

6. Interviews

Interviews take place over video, either through Gigly's own video calling feature or a supported third-party platform. Where a Student has consented, Gigly may send reminder messages and calls ahead of a scheduled interview via SMS, WhatsApp, and automated voice call. Repeated no-shows may affect a Student's reliability score shown to Employers.

7. AI-assisted features

Gigly may use AI-generated match scores and explanations to help Employers and Students assess fit. These are provided as a decision-support aid only — they do not guarantee suitability, are not a substitute for an Employer's own judgment, and must not be relied on as the sole basis for a hiring decision.

8. Acceptable use

You must not: submit false or fraudulent identity documents; use the Service to post or seek unlawful work; harass, discriminate against, or misrepresent yourself to another user; attempt to circumvent Gigly's fees by arranging payment or contact outside the platform after being introduced through it; or interfere with the Service's operation or security.

No contact details in job ads. Employers must not include a phone number, email address, or other direct contact detail in a job listing (title, description, pay rate, or location fields) or any other public-facing content on Gigly. Contact details are exchanged through the Service's own accept/interview flow once a Student has been accepted, not published in an ad — this is what allows Gigly to operate as a marketplace rather than a directory. Gigly may automatically detect and flag listings that appear to contain a phone number or email address for review. Where a violation is confirmed, Gigly may block the Employer's account without notice, in addition to any other rights under section 11 (Termination).

Confidentiality of Student information. An Employer accessing a Student's personal information through Gigly — including profile details, application content, and contact details revealed after acceptance — must keep that information confidential and use it only for the purpose of considering that Student for the relevant role. Neither the Employer nor any of the Employer's own employees, contractors, or other personnel may share, disclose, sell, or otherwise distribute a Student's personal information to any person or organisation outside the Employer's own organisation. This obligation continues even after the Employer's account is closed. An Employer registering on Gigly confirms this undertaking at sign-up.

9. Intellectual property

Gigly and its branding, design, and software are owned by Gigly Pty Ltd. Content you submit (profile information, job listings, application notes) remains yours, but you grant Gigly a licence to use it to operate the Service.

10. Disclaimers and liability

The Service is provided "as is." Gigly does not guarantee that any Student will be hired, that any Employer's job is genuine, that any work arranged through the Service will be performed to any particular standard, or that AI-generated scores are accurate. Gigly is not responsible for the conduct of Students or Employers, on or off the platform, or for any dispute between them arising from work arranged through the Service.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. To the maximum extent permitted by law, and subject to those non-excludable guarantees, Gigly's total liability to you arising out of or in connection with the Service is limited, at Gigly's option, to re-supplying the Service or refunding the amount you paid to Gigly for the specific fee giving rise to the claim, and Gigly is not liable for any indirect, consequential, or special loss.

11. Termination

Gigly may suspend or close an account that breaches these Terms, including for fraudulent documentation or attempts to circumvent fees. You may close your account at any time by contacting hello@gigly.com.au.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.

13. Changes

We may update these Terms from time to time. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
